1. About these Terms
These Terms and Conditions ("Terms") govern your use of the fitness and wellness features of the Iron Fit You application ("IFY" or "App") and the related services covered by these Terms.
The service is operated by Iron Fit You, at 506-507, Fortune Business Hub, Science City Road, Ahmedabad, Gujarat - 380060, India ("we," "our," or "us"). Contact us at info@ironfityou.com.
By accepting these Terms, or using the service after having an opportunity to review them, you agree to them, subject to applicable law. If you do not agree, do not use the service. Any separate consent required to process personal data must be obtained independently of acceptance of these Terms.
2. Fitness and wellness purpose
IFY supports activity tracking, sleep information, heart rate and other supported wellness metrics, recovery scores, trends, and personalized wellness insights. Features depend on your device, permissions, connections, and the version of the service available to you.
The wellness features and Iron Fit Band readings are intended for fitness and general well-being. They are not intended to diagnose, prevent, monitor, or treat disease, prescribe treatment, or replace a qualified healthcare professional. Wellness outputs are not medical advice. Do not change medication, delay care, or make medical decisions based on them.
IFY is not an emergency response or emergency monitoring service. If you suspect a medical emergency, contact local emergency services promptly.
3. Eligibility and younger users
You must be at least 13 years old to use IFY. This minimum does not override higher age limits or parent or guardian authorization required by applicable law.
If you cannot legally enter into a binding contract, a parent or legal guardian must enter into these Terms on your behalf where the law permits this. Users under 18 must have parent or guardian authorization and appropriate supervision where required by law. Required authorization and any separate consent for personal-data processing must be in place before the relevant use or processing begins.
For consent-based online services offered directly to children in Italy, a user under 14 requires authorization from a person with parental responsibility. This does not replace other applicable rules concerning contracts or children's data. Contact info@ironfityou.com with eligibility questions.
4. Accounts and security
Some features require an account. Use the registration and authentication methods offered in the App, provide accurate information, and keep your account details reasonably up to date.
Protect your password, verification codes, and other credentials. Do not share an account or impersonate another person. Tell us promptly if you suspect unauthorized access. You are responsible for your own use and for access you authorize; these Terms do not make you automatically responsible for activity caused by a security failure attributable to us.
5. Permission to use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive permission to use IFY for lawful, non-commercial fitness and wellness purposes. You may not resell the service or transfer this permission except where applicable law or the relevant app-store licence allows it.
The App's software, design, branding, and service content are protected by intellectual-property rights belonging to us or the relevant licensors. No ownership of those rights is transferred to you. Third-party and open-source components remain subject to their applicable licences. Statutory exceptions and rights expressly granted by those licences are preserved.
6. Measurements, connectivity, and safe use
Sensor measurements and calculated metrics are estimates. Accuracy and completeness can vary with device fit, movement, skin contact, battery status, synchronization, permissions, and the quality of information received from connected services. Scores and estimates may change as records are synchronized or calculations are updated.
The Iron Fit Band connects through Bluetooth Low Energy. Some features require a compatible phone, an internet connection, or device permissions. Follow the device's instructions and safety guidance. Use workout and location features safely and avoid interacting with the App when doing so could distract you or others from traffic or other hazards.
Choose activity appropriate to your condition and seek professional advice when needed. Stop exercising and seek appropriate help if you experience concerning symptoms. These precautions do not remove our responsibility under applicable law.
7. AI and automated insights
IFY uses calculations and OpenAI's API to provide supported automated and AI features. AI responses are generated automatically and may be inaccurate, incomplete, outdated, or unsuitable for your circumstances. Similar responses may be generated for other users.
AI responses are general wellness information, not a clinical assessment or a consultation with a healthcare professional. Check important information before acting on it, and refer medical concerns to a qualified professional. Do not use AI outputs for diagnosis, prescribing, treatment decisions, or emergency assessment.
Information supplied to these features is handled as described in the Privacy Policy. Acceptance of these Terms does not replace any additional health-data consent required for a feature.
8. Privacy and account deletion
Our Privacy Policy explains the information we process, our providers and disclosures, retention, international processing, and your privacy rights. We do not sell personal data. Information may be disclosed to service providers or authorized recipients as described in that policy.
You can request account deletion through the account-deletion option in the App's Settings, or by contacting info@ironfityou.com. Deletion is handled according to the Privacy Policy, applicable legal requirements, and relevant backup cycles. Uninstalling the App or disconnecting the band does not automatically delete your account or independently held records in Apple Health or other services.
9. Information and content you supply
You retain any rights you hold in the information and content you submit. Submit only information you are entitled to provide, including any necessary authorization for information concerning another person.
You grant us permission to process submitted content only as reasonably necessary to provide the functions you request and operate the service lawfully, subject to the Privacy Policy and your applicable rights. This permission does not transfer ownership of your content or provide unrestricted rights to sell your personal data or use it for unrelated purposes.
10. Connected services and app stores
You may connect Apple Health through HealthKit or another supported service using the permissions and controls offered for that connection. Those services have their own terms and privacy information. Review them before authorizing access. Removing a connection does not automatically erase information already transferred.
Our providers support hosting, databases, analytics, diagnostics, and AI features as described in the Privacy Policy. Their involvement does not remove our responsibilities to you.
These service Terms are between you and Iron Fit You. Apple and Google are not parties to them. The licence applicable to an app-store copy and the relevant platform rules also apply to its installation and use. We handle IFY support and claims for which we are responsible under applicable law; platform providers retain their own applicable legal and contractual obligations.
11. Charges and product purchases
These Terms do not themselves create a payment obligation. If a paid feature, subscription, trial, or band purchase is offered, the applicable price, taxes, billing period, renewal conditions, cancellation method, and other material purchase terms must be disclosed before you agree to the purchase.
An automatically renewing subscription or a trial that converts to a paid service requires the disclosures and agreement required by applicable law. Cancellation, refund, and withdrawal rights depend on the purchase terms, the payment channel, and applicable consumer law. No purchase term may remove a right that the law does not permit to be waived. Contact info@ironfityou.com for help; where an app store processes payment, its applicable cancellation and refund procedures also apply.
Uninstalling the App or deleting an IFY account does not by itself cancel a separately managed subscription, if any. Follow the cancellation instructions provided for the purchase. Band sales, delivery, returns, and warranties are subject to the information provided for that purchase and applicable law. These App Terms do not replace or reduce statutory product guarantees.
12. Availability and service changes
We may carry out maintenance and make changes reasonably necessary for security, legal compliance, compatibility, or service improvement. We will give appropriate notice of material changes where required, including any available cancellation or other remedy. Urgent security or legal measures may require immediate action.
We do not promise that every feature will always be available or that the service will operate without interruption. Changes, interruptions, and discontinuation remain subject to our contractual obligations and applicable consumer rights, including rights relating to purchased services and required updates.
13. Acceptable use
You must not:
- Access another person's account or data without authorization, impersonate others, or submit information unlawfully.
- Introduce malware, bypass security controls, overload the service, or interfere with its operation.
- Copy, redistribute, scrape, or commercially exploit the service without permission, except where applicable law permits it.
- Reverse engineer or decompile the App except where permitted by law or an applicable licence.
- Use the service for unlawful, abusive, deceptive, or harmful activity, or present wellness estimates or AI outputs as verified clinical findings.
14. Suspension and ending use
We may restrict or suspend access proportionately when reasonably necessary to address a material breach of these Terms, unlawful activity, a security risk, or a legal obligation. Where reasonably possible and lawful, we will explain the reason and allow you to respond or correct the issue. Immediate action may be necessary to prevent harm. You can contact info@ironfityou.com to ask us to review a restriction.
You may stop using IFY and request account deletion at any time. Ending access does not remove accrued rights, mandatory refund rights, or privacy rights. Any lawful retention after deletion is governed by the Privacy Policy.
15. Warranties and liability
We do not guarantee a particular fitness result, a precise measurement in every circumstance, or uninterrupted availability. Any exclusion of a warranty applies only to the extent applicable law permits it. Your statutory rights concerning quality, conformity, safety, and remedies remain available.
Where the law permits, we are not responsible for business losses arising from personal, non-commercial use or losses that were not reasonably foreseeable when these Terms were accepted. Liability otherwise remains subject to applicable law.
Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence where such liability cannot lawfully be limited, or any other liability that applicable law prohibits us from excluding or limiting. In particular, these Terms do not waive mandatory consumer rights in Brazil, India, Italy, or elsewhere, or responsibility for breaches of applicable data-protection law.
16. Updates to these Terms
We may update these Terms for valid reasons such as changes to features, legal requirements, security needs, or our service arrangements. We will identify the revised date and provide appropriate notice of material changes before they take effect where required by law.
Where additional agreement is legally required, we will seek it. Continued use alone does not waive a required consent or a mandatory consumer right. If you disagree with a change, you may stop using the service and exercise any cancellation, refund, or other remedy available under applicable law.
17. Applicable law and disputes
These Terms are governed by Brazilian law, subject to applicable conflict-of-laws rules and mandatory protections that apply to you. This choice does not deprive consumers of protections that cannot be waived under the law of their habitual residence, including applicable protections in India and Italy or under EU law.
Contact info@ironfityou.com if you have a complaint so that we can try to resolve it. This does not prevent you from contacting a regulator, consumer-protection authority, or a court with jurisdiction. These Terms do not require compulsory arbitration or an exclusive foreign court where that would conflict with your statutory rights.
18. General provisions
These Terms govern the IFY fitness and wellness service alongside any purchase terms expressly presented and agreed for a particular purchase. The Privacy Policy explains personal-data processing and does not replace required consents.
If a provision is unenforceable, the remaining provisions continue to apply to the extent the agreement can lawfully continue. A delay in enforcing a right does not by itself waive that right. Translations are intended to convey the same terms; any mandatory rules concerning language, interpretation, and consumer protection remain applicable.
